Restarting California's Gay Marriages: No Contest? By Michael A. Lindenberger, Aug. 13, 2010 - Time

If same-sex weddings resume in California next Thursday, the happy couples may have more names to add to their thank-you lists than that of U.S. District Judge Vaughn Walker, the San Francisco jurist who last week struck down the 2008 voter-approved constitutional amendment that made gay marriage illegal. They may have to address new cards to Governor Arnold Schwarzenegger and California attorney general Jerry Brown.

That's because Brown and Schwarzenegger's choosing not to appeal Walker's Aug. 4 ruling — and their contention that the state is ready to begin issuing same-sex wedding licenses immediately — may turn out to be almost as decisive a factor as the historic court ruling last week. That possibility emerged Thursday in an 11-page ruling Walker issued to deny a request by Proposition 8's proponents for him to delay implementing his own ruling allowing gay marriage until they can appeal the case to the Ninth Circuit and perhaps all the way to the Supreme Court.  The Quality Of Lasting Homosexual Relationships
Deserve Respect
Cardinal Christoph Schönborn, Vienna

In March 1997, after attending a National Symposium of the New Ways Ministry that was held in Pittsburgh, Pennsylvania, I learned that children as young as 4 and 5 years of age know that they are different.  This feeling “different” is only identified in their adult years as being gay. However, the harmful influence of antigay social and religious norms -- in particular, for Catholics the Vatican’s unsubstantiated antigay teachings -- are severe and are lasting throughout a child’s lifetime.  The harmful effects are not isolated only to these children who grow up to be gay, but affects their families, siblings, friends and anyone who they might consider special in their life. It is a prescribed societal sentence of implicit isolation, which places at risk of suicide so many innocent adolescents and young adults. It stifles an enormous amount of human potential in the world that otherwise could be put to use for finding cures for diseases, offer better ways of maintaining peace among people and improve the quality of living for everyone in the world. Read more:

U.S. SUPREME COURT Gay Rights Advocates Seize on
Justice Ginsburg’s ‘Time Bomb’
By Debra Cassens Weiss – July 20, 2010 – ABA Journal

Gay rights advocates are buoyed by a statement in a majority opinion written by Justice Ruth Bader Ginsburg in a decision upholding a law school’s decision to refuse recognition to a Christian legal group that excluded gays and nonbelievers.

Ginsburg’s statement in the 5-4 decision Christian Legal Society v. Martinez “was resolutely bland and nicely hidden,” the New York Times reports. Some compared it the hidden “time bombs” contained in the opinions of Justice William J. Brennan Jr., whose seemingly casual statements or footnotes would be cited to extend the law in future cases.

This is what Ginsburg wrote in a portion of the opinion discussing laws that affect gays and lesbians: “Our decisions have declined to distinguish between status and conduct in this context.” The sentence is important, the Times explains, because courts are more likely to protect groups whose characteristics are immutable, rather than a choice.
