Some thinkers, including several members of the Supreme Court, seem to reason that homosexuality is an inborn status.

Catholicism--and, indeed most religions--teach that while homosexuality exists, homosexual activity is a "disordered" choice against the laws of nature.

If homosexuality is indeed a status rooted in biology or genetics, then homosexuals, like left-handed people, act according to their nature. But if homosexuality is a choice rooted in behavior, then homosexuals act against nature…

In terms of civil rights, individuals deserve and are afforded protections for both status (say, skin color) and choice (for example, religious affiliation).

It must be remembered that the importance and meaning of marriage is more than procreation. Two people pledging their love to each other is not just for themselves, because that is not a marriage. By being in love, two become one and they are better equip to be the best for everyone in world their families, friends, co-workers and beyond. In this way all marriages are contributing to the procreation of children by their enriching the social environment that children will be born into. Introduction
On the historic, horrific morning of September 11, 2001, John kissed his wife, Rosa, goodbye before heading to his job as an office-cleaner in the World Trade Center’s North Tower. Rosa never heard from her husband again. After searching frantically for days, Rosa accepted the reality of his disappearance. She filed for a death certificate and arranged her husband’s memorial service. Rosa received Workers’ Compensation from the state and a small Social Security death benefit from the federal government. She contacted John's former employer, who arranged for receipt of his pension. Because John and Rosa had few assets, they had never seen the need for a will, nor did they have the financial means to hire a lawyer to prepare one. Nonetheless, John's assets, which included a small savings account, their home and a car, were given to Rosa by law.

That same morning, Juan kissed Ryan, his partner of 21 years, goodbye and headed to his job as a file-clerk in that same North Tower. Like Rosa, Ryan never heard from Juan again. Ryan applied for Workers’ Compensation and Social Security, but, unlike Rosa, he was told he was not eligible for those benefits because he was not Juan’s legal spouse. Even though Juan and Ryan had taken some precautions to protect their commitment -- such as registering as domestic partners, designating one another as beneficiaries on insurance policies, and executing health care proxies and powers of attorney -- and even though Juan paid the same taxes as John, Ryan was not automatically entitled to any of the compensations given to Rosa. In addition to his emotional devastation, Ryan was financially devastated as well.

Why did Rosa have an economic safety net, while Ryan did not? The answer can be summed up in two words: “I do.” ...

Marriage makes almost every aspect of a relationship less expensive. Without money, a lawyer or any forethought, married couples receive the benefits of a complex set of legal rules that create default choices most couples would select anyway. Thus:

John Nienstedt's anti-gay marriage crusade draws another protest – by ‎Hart Van Denburg, September 29, 2010 - Minneapolis City Pages

Two projects have now sprung up to slap "Return to Sender" on Archbishop John Nienstedt's mass mailing of 400,000 anti-gay marriage DVDs to Catholics in the Twin Cities.

ReturnTheDVD.org launched on Monday, after Lucinda Naylor set up DVD to Art the week before.

Nienstedt announced the mailing from the St. Paul Minneapolis Archdiocese last week. The DVDs are produced be the Knights of Columbus, and instruct Catholics to obey church teaching opposed to gay marriage. Nienstedt also calls for a state constitutional amendment banning gay marriage as part of the package.

Who We Are
We are a group of Catholics who are concerned about the priorities of the leaders in the Archdiocese of St. Paul and Minneapolis. Their action, distributing 400,000 DVDs on the single subject of same-sex marriage shortly before the upcoming election, reflects misguided priorities and strays from the essential teachings of Christ.

Our call to action is to create some good out of this unfortunate situation.

Congress’ powers are “defined and limited,” and, for that reason, every federal law “must be based on one or more of its powers enumerated in the Constitution.”126 As long as Congress acts pursuant to one of its enumerated powers, “its work product does not offend the Tenth Amendment.”127 Moreover, “[d]ue respect for the decisions of a coordinate branch of Government demands that we invalidate a congressional enactment only upon a plain showing that Congress has exceeded its constitutional bounds.”128 Accordingly, it is for this court to determine whether DOMA represents a valid exercise of congressional authority under the Constitution, and therefore must stand, or indeed has no such footing…

That same-sex marriage is a contentious social issue, as the government argues, does not alter this court’s conclusion. It is clear from the record evidence that rules and regulations regarding marital status determinations have been the subject of controversy throughout American history. Interracial marriage, for example, was at least as contentious a subject. But even as the debate concerning interracial marriage waxed and waned throughout history, the federal government consistently yielded to marital status determinations established by the states. That says something. And this court is convinced that the federal government’s long history of acquiescence in this arena indicates that, indeed, the federal government traditionally regarded marital status determinations as the exclusive province of state government…

That the government views same-sex marriage as a contentious social issue cannot justify its intrusion on the “core of sovereignty retained by the States,”157 because “the Constitution ...divides power among sovereigns and among branches of government precisely so that we may resist the temptation to concentrate power in one location as an expedient solution to the crisis of the day.”158 This court has determined that it is clearly within the authority of the Commonwealth to recognize same-sex marriages among its residents, and to afford those individuals in same-sex marriages any benefits, rights, and privileges to which they are entitled by virtue of their marital status. The federal government, by enacting and enforcing DOMA, plainly encroaches upon the firmly entrenched province of the state, and, in doing so, offends the Tenth Amendment. For that reason, the statute is invalid…

Introduction
On the historic, horrific morning of September 11, 2001, John kissed his wife, Rosa, goodbye before heading to his job as an office-cleaner in the World Trade Center’s North Tower. Rosa never heard from her husband again. After searching frantically for days, Rosa accepted the reality of his disappearance. She filed for a death certificate and arranged her husband’s memorial service. Rosa received Workers’ Compensation from the state and a small Social Security death benefit from the federal government. She contacted John's former employer, who arranged for receipt of his pension. Because John and Rosa had few assets, they had never seen the need for a will, nor did they have the financial means to hire a lawyer to prepare one. Nonetheless, John's assets, which included a small savings account, their home and a car, were given to Rosa by law.

That same morning, Juan kissed Ryan, his partner of 21 years, goodbye and headed to his job as a file-clerk in that same North Tower. Like Rosa, Ryan never heard from Juan again. Ryan applied for Workers’ Compensation and Social Security, but, unlike Rosa, he was told he was not eligible for those benefits because he was not Juan’s legal spouse. Even though Juan and Ryan had taken some precautions to protect their commitment -- such as registering as domestic partners, designating one another as beneficiaries on insurance policies, and executing health care proxies and powers of attorney -- and even though Juan paid the same taxes as John, Ryan was not automatically entitled to any of the compensations given to Rosa. In addition to his emotional devastation, Ryan was financially devastated as well.

Why did Rosa have an economic safety net, while Ryan did not? The answer can be summed up in two words: “I do.” ...

Same-Sex Marriage: A Selective Bibliography of the Legal Literature – by Paul Axel-Lute - Rutgers School of Law–Newark

INTRODUCTION
The movement to open civil marriage to same-sex couples achieved its first temporary success in 1993 with the decision of the Hawaii Supreme Court that the restriction of marriage to opposite-sex couples would be presumed unconstitutional unless the state could demonstrate that it furthered a compelling state interest. In response to this decision the state constitution was amended to allow the legislature to preserve that restriction. A similar court decision in Alaska in 1998 led to an even stronger constitutional amendment, itself defining marriage as between one man and one woman. In further reaction to the Hawaii case, the federal Defense of Marriage Act (1996) provided that no state would be required to recognize a same-sex marriage from another state, and also defined marriage for federal-law purposes as opposite-sex. The majority of the states also passed their own "marriage protection acts." (In November 2004, eleven more U.S. states amended their constitutions to prohibit same-sex marriage.)

In Vermont, after that state's Supreme Court held in 1999 that the state must extend to same- sex couples the same benefits that married couples receive, the legislature in 2000 created the status of "civil union" to fulfill that mandate. Connecticut adopted a similar civil union law in 2005.

In 2001, the Netherlands became the first country to open civil marriage to same-sex couples. Belgium became the second in 2003. In 2002 through 2004, courts in six Canadian provinces held that the opposite-sex definition of marriage was contrary to Canada's Charter of Rights, and in 2005 federal legislation extended same-sex marriage to all of Canada. Same-sex marriage was also legalized in Spain in 2005 , in South Africa in 2006, in Norway and Sweden effective in 2009, and in Portugal, Iceland, and Argentina effective in 2010.

In November 2003, the Massachusetts Supreme Judicial Court held that excluding same-sex couples from the benefits of civil marriage violated the state constitution, and in February 2004 that court further held that a "civil union" law would not be sufficient, and on May 17, 2004 Massachusetts became the first state in the United States where same-sex marriage per se is legal.

Basilica Artist Suspended Over DVD to ART Project – September 27, 2010 - My Fox Twin Cities

MINNEAPOLIS - Basilica of St. Mary Artist in Residence Lucinda Naylor was suspended Saturday after posting her intention on Facebook to turn anti gay marriage DVDs into an art project…

Last week, the Minnesota Catholic Conference started mailing DVDs to Catholics across the state. The DVDs ask voters to watch and listen to the DVDs and contact their state lawmakers…

Naylor wants to "create a beautiful piece of art using the free art materials being sent out by the archbishop." She said she wants to "transform the DVDs of fear into art of hope" and is asking anyone with a copy to send it her way.

Catholics to get DVDs OPPOSING GAY MARRIAGE

Critics say the mailing, from state bishops, is aimed at November voters.

More than 400,000 DVDs are being mailed to the homes of Minnesota Catholics on Wednesday, courtesy of Catholic bishops in the state who want to stop the campaign to legalize same-sex marriage in its tracks.

The 18-minute DVD includes an appearance from St. Paul and Minneapolis Archbishop John Nienstedt in which he says it is time for Minnesotans -- not the "ruling elite" of legislators and judges -- to vote on a constitutional amendment defining marriage as between one man and one woman. Thirty-one states have passed such an amendment.

"It is the people themselves and not politicians or judges who should make this decision," Nienstedt says on the DVD. "This is the only way to put the one man, one woman definition of marriage beyond the reach of the courts and politicians."
